  1. Strengthened Fire Safety Measures: The new Act requires comprehensive Fire Risk Assessments for all high-rise residential buildings. This entails identifying potential fire hazards, assessing the risk, and implementing appropriate preventive and protective measures. Fire detection and suppression systems, including sprinklers and fire alarms, are to be installed and maintained to meet stringent standards. The Act also emphasises the need for robust evacuation strategies and the provision of safe refuge areas, where necessary.

  2. Enhanced Structural Integrity: High profile tragic incidents in the recent past have highlighted the crucial need to ensure the structural integrity of buildings. The Act introduces more rigorous processes for structural design, construction, and ongoing maintenance. They emphasise the importance of competent professionals, including architects and engineers, who must demonstrate their qualifications and adherence to relevant codes and standards. Regular structural inspections and assessments will be required, with clear protocols for addressing any identified deficiencies promptly.

  3. Accountability and Building Safety Managers: To ensure accountability throughout a building's lifecycle, the Act introduces the role of the Building Safety Manager (BSM). BSMs will be responsible for overseeing and coordinating all aspects of building safety, including fire safety, structural integrity, and ongoing maintenance. These professionals will play a pivotal role in promoting a culture of safety, facilitating communication among stakeholders, and ensuring compliance with the regulations. They will also be instrumental in maintaining accurate records, including a Building Safety Case, which will document the safety measures implemented and any ongoing risks.

  4. Gateway Process and Building Safety Regulator: To ensure that safety considerations are integrated at each stage of a building's lifecycle, a new Gateway Process has been implemented. This process establishes mandatory checkpoints for obtaining approvals during design, construction, and occupation phases. It promotes effective collaboration among all parties involved, including developers, contractors, and regulatory bodies. Additionally, the Building Safety Regulator has been established to oversee the regulatory framework, enforce compliance, and provide guidance and support to industry professionals.  BSR is an independent body set-up by the Building Safety Act 2022 and part of the Health and Safety Executive (HSE).  All BSMs must now register their high-rise building with this organisation.  The HSE states that “Registration is a crucial part of the new regime and our efforts to ensure residents of high-rise buildings feel protected and safe in their homes.”

  5. Cultural Shift and Resident Engagement: The Act recognises the importance of a cultural shift in the construction industry, emphasising a proactive approach to building safety. They encourage greater resident engagement, empowering those living in high-rise buildings to actively participate in safety processes and voice their concerns. The regulations promote the establishment of Resident Engagement Strategies, ensuring that residents are kept informed, involved in decision-making, and have access to clear channels of communication regarding building safety matters.

The new Building Safety Act represents a significant milestone in safeguarding the occupants of residential and high-rise buildings.

Adhering to the Act will not only ensure compliance but also instill confidence in occupants, stakeholders, and the public at large.
